This study aims to analyze the impact of blockchain on smart contracts and its implications for contract law through a descriptive-analytical method. The findings reveal that the primary legal challenges of smart contracts include issues of validity and enforceability, obstacles to acceptance in national laws, dispute resolution, alignment with existing regulations, responsibilities of parties, effects on property rights, and liabilities arising from contract breaches. Addressing these challenges requires new legal frameworks and the development of technical and security standards. One key innovation of this research is the introduction of blockchain-based dispute resolution mechanisms, which can simultaneously address legal and technical problems. To effectively utilize blockchain and smart contracts, it is recommended that legislative bodies draft harmonized international laws and design efficient dispute resolution mechanisms. Additionally, collaboration between legal experts and technical specialists is essential for developing appropriate protocols and technical standards. Such collaborations can lead to the creation of new legal frameworks, facilitate the adoption of blockchain technology in various legal systems, and ultimately reduce existing legal challenges. فناوری بلاک‌چین و قراردادهای هوشمند تحولی عظیم در عرصه حقوق و قراردادها ایجاد کرده‌اند. این پژوهش با هدف بررسی اثرات بلاک‌چین بر قراردادهای هوشمند و تبعات آن بر حقوق قراردادها از طریق یک روش توصیفی-تحلیلی انجام شده است. یافته‌ها نشان می‌دهند که مهم‌ترین چالش‌های حقوقی قراردادهای هوشمند شامل مسائل اعتبار و قابلیت اجرایی، موانع پذیرش در قوانین ملی، حل و فصل اختلافات، هم‌راستایی با قوانین موجود، مسئولیت‌های طرفین، تأثیرات بر حقوق مالکیت و مسئولیت‌های ناشی از نقص قراردادها است. این چالش‌ها نیازمند چارچوب‌های حقوقی جدید و توسعه استانداردهای فنی و امنیتی است. به‌منظور بهره‌برداری مؤثر از بلاک‌چین و قراردادهای هوشمند، پیشنهاد می‌شود که نهادهای قانون‌گذار به تدوین قوانین بین‌المللی هماهنگ پرداخته و مکانیسم‌های حل اختلاف کارآمدی را طراحی کنند. همچنین، همکاری بین متخصصان حقوقی و فنی برای توسعه پروتکل‌های مناسب و استانداردهای فنی ضروری است. این همکاری‌ها می‌توانند موجب ایجاد چارچوب‌های قانونی جدید و تسهیل پذیرش فناوری بلاک‌چین در نظام‌های قانونی مختلف شوند و در نتیجه، چالش‌های حقوقی موجود را کاهش دهند. /downloadfilepdf/1215895
