Nevertheless, determining the legal status of these assets during processes such as mortgaging, seizure, and the enforcement of official documents presents challenges. This is because some equipment may be legally classified as movable property, while other items—due to their attachment or dedication to a building or industrial facility—may be subject to debate regarding their status as immovable property or accessory assets. Furthermore, complex legal situations may arise due to factors such as ownership registration, financing agreements, leasing, rental arrangements, retention-of-title clauses, or the existence of third-party rights. The primary objective of this research is to examine the feasibility and procedures for mortgaging and seizing machinery and production line equipment in the refining and petrochemical sectors, while analyzing the distinctions in their legal status, registration formalities, and the operational practices of notaries public and registration offices. The study employs a descriptive-analytical approach, drawing upon statutory sources, registration documents and regulations, legal literature, and comparative studies. Additionally, the empirical component of the research utilizes a sample group comprising 100 individuals, including legal experts, registration specialists, notaries public, registration office staff, and experts in industrial contract law. The findings indicate that the most significant challenge is the absence of a fully integrated system for the identification, description, registration, and enforcement of real rights and security interests regarding industrial equipment. Furthermore, the more precisely the technical specifications, serial numbers, location, ownership, and contractual status of the equipment are recorded in the document, the lower the likelihood of disputes arising during seizure and collateral enforcement. Accordingly, establishing a comprehensive mechanism for registering industrial equipment data—alongside coordination among notaries public, the registration office, judicial authorities, and relevant agencies—can enhance legal security for financing in the refining and petrochemical industries. ماشین آلات، تجهیزات ثابت و متحرک، خطوط تولید و تأسیسات فنی در صنایع پالایشگاهی و پتروشیمی از مهم ترین دارایی های سرمایه ای بنگاه های صنعتی محسوب می شوند و در بسیاری از موارد ارزش اقتصادی آنها از املاک محل استقرار واحد صنعتی نیز بیشتر است. با وجود این، تعیین وضعیت حقوقی این اموال در هنگام ترهین، توقیف و اجرای اسناد رسمی با دشواری هایی مواجه است؛ زیرا برخی تجهیزات ممکن است از حیث حقوقی مال منقول تلقی شوند، برخی به واسطه اتصال و اختصاص به بنا یا تأسیسات صنعتی در معرض بحث درباره وصف غیرمنقول یا مال تابع قرار گیرند و برخی دیگر نیز به دلیل ثبت مالکیت، قراردادهای تأمین مالی، لیزینگ، اجاره، حفظ مالکیت یا وجود حقوق اشخاص ثالث، وضعیت پیچیده ای پیدا کنند.مسئله اصلی پژوهش حاضر، بررسی امکان و نحوه ترهین و توقیف ماشین آلات و تجهیزات خطوط تولید در صنایع پالایشگاهی و پتروشیمی و تحلیل تفاوت میان وضعیت حقوقی این اموال، تشریفات ثبتی و رویه عملی دفاتر اسناد رسمی و ادارات ثبت است. پژوهش با روش توصیفی ـ تحلیلی و با بهره گیری از منابع قانونی، اسناد و مقررات ثبتی، منابع حقوقی و مطالعات تطبیقی انجام شده است. در بخش تجربی نیز جامعه نمونه ای متشکل از ۱۰۰ نفر از کارشناسان حقوقی، کارشناسان ثبتی، سردفتران، کارکنان ثبتی و متخصصان حقوق قراردادهای صنعتی در نظر گرفته شده است.یافته های پژوهش نشان می دهد که مهم ترین چالش، فقدان یک نظام کاملاً یکپارچه برای شناسایی، توصیف، ثبت و اجرای حقوق عینی و تضمینی نسبت به تجهیزات صنعتی است. همچنین، هرچه مشخصات فنی، شماره سریال، محل استقرار، مالکیت و وضعیت قراردادی تجهیزات دقیق تر در سند درج شود، امکان تعارض در زمان توقیف و اجرای وثیقه کاهش می یابد. بر این اساس، ایجاد سازوکار جامع برای ثبت اطلاعات تجهیزات صنعتی و هماهنگی میان دفاتر اسناد رسمی، اداره ثبت، مراجع قضایی و دستگاه های مرتبط می تواند موجب افزایش امنیت حقوقی تأمین مالی صنایع پالایشگاهی و پتروشیمی شود. https://hljr.ir/downloadfilepdf/1265350
