Arbitration, as one of the most significant methods of private dispute resolution, has secured a prominent position within the Iranian legal system. Recourse to arbitration is typically motivated by the desire for a specialized, relatively swift, flexible, and less formalistic dispute resolution mechanism. In this context, the arbitrator—deriving the authority to adjudicate the dispute from either the parties' agreement or the law—occupies a dual position: on one hand, their relationship with the parties is contractual in nature; on the other, they perform a quasi-judicial, adjudicative function during the proceedings. This duality has made the determination of the basis and scope of the arbitrator's civil liability, the conditions for its establishment, and the relationship between such liability and the validity or annulment of the arbitral award key subjects of legal debate. Under Iranian law, Article 501 of the Civil Procedure Code for Public and Revolutionary Courts serves as a crucial basis for the arbitrator's civil liability. Pursuant to this article, if financial loss is incurred by one or both parties due to deceit, fraud, or fault in the performance of arbitral duties, the arbitrator(s) shall be liable for compensation. Consequently, an arbitrator's liability under Iranian law cannot be equated solely with the annulment of the arbitral award, as annulment may stem from grounds that do not necessarily involve arbitrator fault. Recent legal scholarship has also emphasized the absence of a definitive correlation between the annulment of an award and the arbitrator's civil liability. Using a descriptive-analytical method and drawing upon library resources, statutes, regulations, legal literature, and comparative studies, this research examines the foundations of an arbitrator's civil liability, the conditions for establishing such liability, its scope, instances of breach of duty, the relationship between the annulment of an award and civil liability, and applicable legal sanctions. The findings indicate that the element of fault plays a pivotal role in the Iranian legal system; the mere issuance of an award that is subsequently annulled is insufficient, in itself, to establish an arbitrator's civil liability. Furthermore, a distinction must be drawn between "liability arising from the arbitrator's adjudicative function" and "liability arising from the breach of contractual and professional obligations." The study concludes that the appropriate model for Iranian law is neither absolute immunity nor absolute liability, but rather a fault-based liability regime that safeguards the arbitrator's independence—permitting claims for damages in cases involving deceit, fraud, bad faith, or a manifest and attributable breach of duty.
