    <Abstract>Article 51 of the Charter of the United Nations recognizes the inherent right of self-defense as an exception to the general rule prohibiting the use of force. However, ambiguity in the definition and scope of this right has created a gap between the doctrine and jurisprudence of the International Court of Justice. In cases such as Nicaragua (1986), Oil Rigs (2003), Barrier (2004) and Congo (2005), the Court has adopted a conservative approach and, by remaining silent on fundamental questions, has created a legal vacuum in the collective security system. This article examines the question of whether Islamic jurisprudence can fill these gaps in the Court’s case law as a complementary interpretative source using an analytical-comparative approach. The findings show that concepts such as repellent jihad, reasonable fear, the rule of least danger and limitation to the extent of necessity in Islamic jurisprudence are in line with the spirit of Article 51 and, in cases such as legitimate preemptive defense, provide more objective and ethically-oriented criteria than positivist interpretations. Based on Article 38(c) of the Court’s Statute, the article proposes a four-pillar model for invoking Islamic jurisprudence as an interpretative tool.

    <OtherAbstract Language="FA">ماده ۵1 منشور ملل متحد، حق ذاتی دفاع مشروع را به عنوان استثنایی بر قاعده عام منع توسل به زور به رسمیت می 
شناسد. با این حال، ابهام در تعریف و دامنه این حق، شکاف میان دکترین و رویه قضایی دیوان بین المللی دادگستری را 
دامن زده است. دیوان در آرایی چون نیکاراگوئه )1۹۸۶(، سکو های نفتی )2۰۰۳(، دیوار حائل )2۰۰۴( و کنگو 
)2۰۰۵(، رویه ای محافظه کارانه اتخاذ کرده و با سکوت در برابر پرسش های اساسی، خأل حقوقی در نظام امنیت جمعی 
ایجاد کرده است. 
این مقاله با روش تحلیلی – تطبیقی این پرسش را بررسی می کند که آیا فقه اسالمی می تواند به عنوان منبع تفسیری 
مکمل، این خأل ها را در رویه دیوان پر کند. یافته ها نشان می دهد مفاهیمی چون جهاد دفعی، خوف معقول، قاعده 
اخف الضررین و تقید به قدر ضرورت در فقه اسالمی، با روح ماده ۵1 همسو هستند و در مواردی مانند دفاع پیش 
دستانه مشروع، معیار های عینی تر و اخالق محورتری نسبت به تفاسیر پوزیتیویستی ارائه می دهند. مقاله با تکیه بر 
بند )ج( ماده ۳۸ اساسنامه دیوان، مدلی چهار رکنی برای استناد به فقه اسالمی به عنوان ابزار تفسیری پیشنهاد می 
کند.
