Therefore, the regulation of a lawyer’s professional conduct cannot be limited only to the general rules governing the contract of agency or scattered disciplinary regulations. In American law, the Model Rules of Professional Conduct, which were adopted in 1983, have provided a national framework for regulating the standards of professional conduct of lawyers. In Iranian law, although there is no comprehensive and independent law with a structure similar to the Model Rules, a collection of provisions of the Civil Code, the Law on Attorneys, the Legal Bill on the Independence of the Bar Association, and its implementing regulations covers a significant part of the professional duties of a lawyer. In fact, there is considerable overlap between the two systems in principles such as competence, diligence, confidentiality, and loyalty; however, the rules of professional conduct of the American Bar Association are, in many areas, more structured, more detailed, and more coherent in terms of distinguishing situations involving conflicts of interest, confidentiality, communication with the court, and professional advertising. حرفه وکالت از جمله حرفههای حقوقی است که کیفیت عملکرد آن، افزون بر تأثیر مستقیم بر حقوق و منافع موکل، با کارآمدی دادرسی، اعتماد عمومی به دادگستری و تحقق عدالت ارتباط دارد. از این رو، تنظیم رفتار حرفهای وکیل نمیتواند تنها به قواعد عمومی قرارداد وکالت یا مقررات انتظامی پراکنده محدود شود. در حقوق آمریکا، قواعد نمونه رفتار حرفه ای که در سال ۱۹۸۳ به تصویب رسیدند، چارچوبی ملی برای تنظیم استانداردهای رفتار حرفهای وکلا فراهم کردهاند.در حقوق ایران نیز اگرچه قانون جامع و مستقلی با ساختار قواعد نمونه وجود ندارد، مجموعهای از مقررات قانون مدنی، قانون وکالت، لایحه قانونی استقلال کانون وکلای دادگستری، آییننامه اجرایی آن، بخش مهمی از تکالیف حرفهای وکیل را پوشش میدهد. در واقع هر دو نظام در اصولی مانند صلاحیت، جدیت، رازداری، وفاداری،همپوشانی قابل توجهی وجود دارد؛ با این حال، قواعد رفتار حرفه ای کانون وکلای دادگستری آمریکا در بسیاری از حوزهها ساختارمندتر، تفصیلیتر و از حیث تفکیک موقعیتهای تعارض منافع، محرمانگی، ارتباط با دادگاه و تبلیغات حرفهای منسجم تر است. https://hljr.ir/downloadfilepdf/1588399
