This is mainly true in cases where the perpetrator suffers from a complete mental disorder, not a partial mental disorder. The Islamic Penal Code of 1991 does not distinguish between the aforementioned disorders, and the Islamic Penal Code of 2013, despite taking this issue into account to some extent, is silent in determining the response to individuals with partial mental disorders, which is itself one of the shortcomings of the approach of the aforementioned law. The focus of the latter law is also to remove criminal liability as a result of insanity; however, the method of determining insanity, its conditions, and appropriate responses for insane perpetrators have not been given much attention. In contrast, in the German legal system, insanity is considered in both substantive law and judicial practice, the conditions for its determination are specified, and overall, it is more detailed. Accordingly, it seems that we can benefit from the positive aspects of this approach in the Iranian legal system. درصورتی که شخصی در حال جنون مرتکب جرم شود، در نظام‌های حقوقی مختلف پذیرفته شده است که برخورد با او در مقایسه با اشخاص دارای سلامتِ روانی باید متفاوت باشد و با لحاظ سایر شرایط، فاقد مسئولیت کیفری شناخته شود. این امر اصولاً در مواردی صدق می‌کند که مرتکب دچار اختلال روانی تام است، نه اختلال روانی نسبی. قانون مجازات اسلامی 1370ش، تفاوتی میان اختلال‌های یادشده قائل نیست و قانون مجازات اسلامی 1392ش نیز باوجود اینکه به‌نوعی این موضوع را مورد توجه قرار داده، در تعیین واکنش نسبت به افراد دچار اختلال نسبی سکوت اختیار کرده است که خود ازجمله نواقصِ رویکرد قانون یادشده به‌شمار می‌آید. همچنین کانون توجه قانون اخیر عبارت است از رفع مسئولیت کیفری در نتیجۀ عارض شدن جنون؛ اما چگونگی احراز جنون، شرایط آن و پاسخ‌های مناسب برای مرتکبانِ مجنون چندان مورد توجه قرار نگرفته‌ است. درمقابل، در نظام حقوقی آلمان به جنون، هم در قانون موضوعه و هم در رویۀ قضایی توجه شده، شرایط احراز آن مشخص گردیده و درمجموع، دارای تفصیل بیشتری است. بر این اساس، به‌نظر می‌رسد که می‌توان از ابعاد مثبت این رویکرد در نظام حقوقی ایران بهره‌مند شد. /downloadfilepdf/295192
