In the meantime, the process of detecting and prosecuting crimes, as key axes of the criminal justice system, has been increasingly influenced by technological tools and intelligent algorithms. The introduction of technologies such as data mining, machine learning, big data analysis, facial recognition systems, and cyberspace analysis tools has opened new horizons for policymakers and judicial institutions in identifying and pursuing more effectively all types of crimes, especially cyber and organized crimes. However, the legal, ethical, and social implications and consequences of using these technologies are still a subject of debate and challenge in different legal systems, including Iran. The main objective of this article is to explain and analyze the role and impact of artificial intelligence and digital technologies on the process of detecting and prosecuting crimes in the Iranian criminal justice system. It attempts to review international experiences and previous studies, as well as to examine the opportunities and threats arising from the application of technology in the country's legal and executive context. In this regard, the article first explains key concepts and tools and analyzes the legal and operational status of detecting and prosecuting crimes in Iran. Then, by reviewing domestic and foreign studies and examples, the practical applications of artificial intelligence in identifying digital evidence, crime prediction systems, and facilitating judicial decision-making are described. In the following, challenges such as privacy protection, criminal liability due to algorithmic error or bias, and related legal gaps are analyzed. Finally, the article emphasizes the need to develop up-to-date legal frameworks, improve the technological literacy of criminal justice activists, and institutionalize the principles of transparency and accountability, and suggests solutions for the responsible and effective use of technology in the service of justice. The findings indicate that intelligent and accurate use of modern technologies can improve the quality of crime detection and prosecution and therefore lead to the realization of effective criminal justice in Iran. در دهه‌های اخیر، گسترش فناوری‌های نوین دیجیتال و هوش مصنوعی (AI) منجر به تحولات گسترده‌ای در ساختار، کارکرد و اثربخشی نظام‌های عدالت کیفری در سراسر جهان شده است. در این میان، فرآیند کشف و تعقیب جرایم به‌عنوان محورهای کلیدی نظام عدالت کیفری، بیش از پیش متاثر از ابزارهای فناورانه و الگوریتم‌های هوشمند گردیده‌اند. ورود فناوری‌هایی نظیر داده‌کاوی، یادگیری ماشین، تحلیل کلان داده‌ها، سیستم‌های تشخیص چهره، و ابزارهای تحلیل فضای مجازی، افق‌های نوینی را در شناسایی و پیگیری مؤثرتر انواع جرایم، به ویژه جرایم سایبری و سازمان‌یافته، پیش روی سیاست‌گذاران و نهادهای قضایی نهاده است. با این حال، آثار و پیامدهای حقوقی، اخلاقی و اجتماعی بهره‌گیری از این فناوری‌ها همچنان موضوع بحث و چالش در اقوام مختلف نظام‌های حقوقی، از جمله ایران، می‌باشد. هدف اصلی این مقاله، تبیین و تحلیل نقش و تأثیر هوش مصنوعی و فناوری‌های دیجیتال بر فرآیند کشف و تعقیب جرایم در نظام عدالت کیفری ایران است و تلاش دارد ضمن مرور تجربیات بین‌المللی و مطالعات پیشین، به بررسی فرصت‌ها و تهدیدهای ناشی از کاربست فناوری در بستر حقوقی و اجرایی کشور بپردازد. در این راستا، مقاله ابتدا به تبیین مفاهیم و ابزارهای کلیدی پرداخته و جایگاه قانونی و عملیاتی کشف و تعقیب جرم را در ایران تحلیل می‌کند. سپس با بررسی مطالعات و نمونه‌های داخلی و خارجی، کاربردهای عملی هوش مصنوعی در شناسایی شواهد دیجیتال، سیستم‌های پیش‌بینی جرم و تسهیل تصمیم‌گیری قضایی تشریح شده و در ادامه، چالش‌هایی چون حفظ حریم خصوصی، مسئولیت کیفری ناشی از خطا یا سوگیری الگوریتمی و خلأهای قانونی مرتبط واکاوی می‌گردد. در پایان، مقاله بر ضرورت تدوین چارچوب‌های قانونی به‌روز، ارتقای سواد فناورانه فعالان حوزه عدالت کیفری و نهادینه‌سازی اصول شفافیت و پاسخگویی تأکید کرده و راهکارهایی برای استفاده مسئولانه و اثربخش از فناوری در خدمت عدالت پیشنهاد می‌دهد. یافته‌ها حاکی از آن است که بهره‌برداری هوشمندانه و دقیق از فناوری‌های نوین می‌تواند به ارتقای کیفیت کشف و تعقیب جرم و بنابرین تحقق عدالت کیفری مؤثر در ایران منجر گردد. /downloadfilepdf/574688
