    <ArticleTitle>Examining the Application of the Rule of Darʾ in the Jurisprudence of the Supreme Court of Iran: A Comparative and Qualitative Analysis of Reversed Judgments in Ḥadd Offenses</ArticleTitle>

    <Abstract>Abstract:
The Darʾ (Rule of Avoidance) is one of the most significant principles of Islamic criminal jurisprudence, playing a fundamental role in safeguarding the rights of defendants and preventing the improper enforcement of hudud punishments. Derived from the well-known Prophetic tradition, “Avoid the enforcement of hudud punishments in cases of doubt” (Idraʾū al-ḥudūd bi al-shubuhāt), the rule is founded on the principle that whenever a material doubt exists regarding the constituent elements of an offense, the attribution of the conduct to the accused, the conditions of criminal responsibility, or the evidence establishing the offense, the imposition of a hadd punishment must be precluded. Inspired by the principles of Imami (Ja’fari) jurisprudence, the Iranian legislature has incorporated this doctrine into various provisions of the 2013 Islamic Penal Code. Nevertheless, an examination of the jurisprudence of the Supreme Court of Iran reveals that the interpretation and application of the Darʾ rule have not been uniform across cases. In several instances, divergent judicial interpretations have led to the reversal of judgments issued by courts of first instance and appellate courts.
This study employs a descriptive-analytical methodology and a qualitative analysis of published decisions of the Supreme Court of Iran to examine the criteria governing the application of the Darʾ rule in hudud crimes and to analyze the Court’s legal and juristic reasoning in overturning lower-court judgments. The findings indicate that the Supreme Court has generally emphasized the principles of caution in matters involving life and sexual integrity, the necessity of attaining judicial certainty, and the strict interpretation of evidentiary standards in hudud offenses. However, the absence of clear criteria for identifying what constitutes a “material doubt” and the differing interpretations adopted by various chambers of the Court have resulted in inconsistent judicial practices. The study concludes that developing coherent interpretative standards and establishing a unified judicial approach to the application of the Darʾ rule would not only strengthen the protection of defendants’ rights but also enhance judicial certainty and promote greater consistency in the jurisprudence of the Supreme Court of Iran.</Abstract>

قاعده «درء» به عنوان یکی از مهم ترین قواعد فقه جزایی اسلام، نقش بنیادینی در تضمین حقوق متهمان و پیشگیری از اجرای ناصحیح مجازات های حدی ایفا می کند. این قاعده که بر پایه حدیث مشهور «ادرءوا الحدود بالشبهات» شکل گرفته است، بر این اصل استوار است که هرگاه در تحقق ارکان جرم، انتساب رفتار، شرایط مسئولیت کیفری یا ادله اثبات جرم، شبهه ای مؤثر وجود داشته باشد، اجرای حد منتفی خواهد بود. قانون گذار ایران نیز با الهام از مبانی فقه امامیه، این قاعده را در مواد مختلف قانون مجازات اسلامی ۱۳۹۲ موردشناسایی قرار داده است. با وجود این، بررسی آرای دیوان عالی کشور نشان می دهد که نحوه تفسیر و اعمال قاعده درء در پرونده های مختلف یکسان نبوده و در برخی موارد، همین اختلاف برداشت موجب نقض آرای دادگاه های بدوی و تجدیدنظر شده است.
پژوهش حاضر با روش توصیفی – تحلیلی و با بهره گیری از مطالعه کیفی آرای منتشرشده دیوان عالی کشور، در پی واکاوی معیارهای اعمال قاعده درء در جرایم حدی و تحلیل استدلال های حقوقی و فقهی دیوان در نقض آرای صادره است. یافته های پژوهش نشان می دهد که دیوان عالی کشور در اغلب موارد، بر اصل احتیاط در دماء و فروج، لزوم احراز یقین قضایی و تفسیر مضیق ادله اثبات جرایم حدی تأکید کرده است؛ بااین حال، نبود معیارهای روشن برای تشخیص «شبهه مؤثر» و تفاوت در برداشت شعب مختلف، به شکل گیری رویه های متفاوت انجامیده است. پژوهش نتیجه می گیرد که تدوین ضوابط تفسیری منسجم و ایجاد وحدت رویه در اعمال قاعده درء می تواند ضمن تضمین حقوق متهمان، به افزایش امنیت قضایی و انسجام رویه دیوان عالی کشور کمک کند.</OtherAbstract>
