With the expansion of transnational crimes, terrorism, corruption, organized crime, and political offenses, extradition has gained increasing importance. This article adopts a descriptive-analytical approach to examine the legal foundations of extradition, its conditions and limitations, the distinction between political and non-political offenders, the rights of suspects and convicted persons, the role of bilateral and multilateral treaties, and the impact of human rights instruments on extradition procedures. Furthermore, the jurisprudence of the International Court of Justice, regional human rights courts, and contemporary international cases are analyzed. The study demonstrates that while extradition is an essential tool in combating impunity, failure to comply with human rights standards may transform it into a mechanism for violating fundamental rights. The article concludes by proposing legal solutions to balance criminal justice, state sovereignty, and human rights obligations. چکیده : ( فارسی ) استرداد مجرمین یکی از قدیمی‌ترین و در عین حال پیچیده‌ترین نهادهای حقوق بین‌الملل کیفری است که در نقطه تلاقی حاکمیت دولت‌ها، همکاری قضایی بین‌المللی و حمایت از حقوق بشر قرار دارد. با گسترش جرایم فراملی، تروریسم، فساد، جرایم سازمان‌یافته و جرایم سیاسی، اهمیت استرداد مجرمین بیش از پیش افزایش یافته است. این مقاله با رویکردی تحلیلی – توصیفی به بررسی مبانی حقوقی استرداد، شرایط و موانع آن، تمایز میان مجرمین سیاسی و غیرسیاسی، حقوق متهمین و محکومین، نقش معاهدات دوجانبه و چندجانبه، و تأثیر اسناد حقوق بشری بر فرآیند استرداد می‌پردازد. همچنین، رویه دیوان بین‌المللی دادگستری، دادگاه‌های منطقه‌ای حقوق بشر و مصادیق معاصر بین‌المللی مورد تحلیل قرار می‌گیرد. مقاله نشان می‌دهد که اگرچه استرداد ابزاری ضروری برای مبارزه با بی‌کیفرمانی است، اما عدم رعایت استانداردهای حقوق بشری می‌تواند آن را به ابزاری برای نقض حقوق بنیادین افراد تبدیل کند. در پایان، راهکارهایی برای ایجاد توازن میان عدالت کیفری، حاکمیت دولت‌ها و تعهدات حقوق بشری ارائه می‌شود. /downloadfilepdf/989427
